ABSTRACT
the work intends to contextualize the development of modern State and modern constitutionalism, approaching its concepts and historic deployments, reflected in the liberal and social experiences to the institution of rights. Moreover, it analyses the aspects that conform the experience of the contemporary constitutionalism, in the perspective of the movement called neoconstitutionalism, and also a proposition of a warranty constitutionalism conceived by the jurist Luigi Ferrajoli. In this context, it is elaborated a panorama about the mainly characteristics of each paradigm and some correspondent criticisms to elucidate the evolution, the conceptions and the theories that sustain each phase of the constitutionalism, allowing the observation of the current tendencies to attribute normativity to constitutions.
