ABSTRACT
The article reports on the arguments given by the lawyers of Lehman Brothers Holdings Inc. against the motion of New York State Comptroller Thomas DiNapoli to call for trustee. The lawyers have opposed on the plan of DiNapoli to appoint a trustee who will oversee the bankruptcy proceedings of the company. The lawyers believe that the DiNapoli fails to acknowledge that the company is also a victim of the financial crisis which is beyond its control.
